New Training Requirement for Businesses

Beginning July 1, 2019, all businesses are required to have training before bidding and/or performing work on public works projects. In 2018, the legislature passed ESSHB 1673 (app.leg.wa.gov) adding this training requirement to the responsible bidder criteria in RCW 39.04.350 (app.leg.wa.gov).

Who needs training?

If you are NOT on this list of exempt businesses (2 MB PDF), you are required to take this training before bidding and/or working on public works projects on or after July 1, 2019. (The list is effective as of April 12, 2019, and will be updated again in May 2019.)

Who’s exempt?

You are exempt from this training requirement if you’ve been in business with an active Unified Business Identifier (UBI) number for 3 or more years AND have performed work on 3 or more public works projects.

NoteYou may continue working on a public works project that starts before July 1, 2019, and continues on or after July 1 without needing to meet this training requirement.

Online

Coming mid-to-late Spring 2019, businesses will be able to access online training through their Prevailing Wage Intent and Affidavit portal. You’ll be able to take this training at your own pace during any time of the day! Once completed, you’ll meet this new requirement.

This option will be available at least 4 weeks prior to July 1, 2019, and it is highly recommend you wait for it to become available. The in-person classes are limited and cannot accommodate all businesses needing this training before July 1.

In-person

Check out L&I’s Contractor Training Days held around the state to sign up and attend our in-person, 3-hour training class. Sign up early as classes and registrations are limited.

Bidding on public works projects

You’ll need to ensure you meet this training requirement before submitting a bid on or after July 1, 2019, for public works projects. Awarding agencies will be required to verify all contractors submitting bids meet this new requirement before awarding the contract. 

Verifying businesses meet this requirement

For projects starting on or after July 1, 2019, you’ll need to add this training requirement to the items you use to verify a business is responsible before hiring and working on public works projects, as required in RCW 39.06.020 (app.leg.wa.gov). 

Coming mid-to-late Spring 2019, you’ll be able to verify businesses have received or are exempt from this training requirement using your Check Contractor Status tool within My L&I or Verify a Contractor tool.
